We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Please make sure you check this page periodically for them. Continued use of or access to the website post changes constitutes acceptance of those changes.

AVAILABILITY

This website does not currently show real-time inventory. Contact our staff anytime to check stock of items you are interested in purchasing. Occasionally items listed on the website are no longer available from our inventory or from our suppliers' inventories. If you order an item that is no longer available we will cancel the order and release the authorization on your payment method immediately. This happens more frequently with sale and closeout items since they generally have limited availability. We strongly recommend you check stock prior to ordering.

ERRORS

In the event that a product has been mistakenly listed or at an incorrect price, we reserve the right to refuse or cancel any orders placed for product listed at the incorrect price, or for orders in which the total has been calculated incorrectly. We have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall issue a credit to your credit card account in the amount of the incorrect price.

PRODUCT NOTICE

For certain brands where applicable, we strongly recommend contacting your local distributor to find an dealer near you for purchasing instead should you require full support and warranty.

Unless specifically mentioned otherwise by the manufacturer, all products sold by us are assumed to be designed and manufactured strictly for racing applications on street machines that are used for racing. They are not intended for street use, and some products may, in some localities, be illegal for street use. Please check your local regulations before making a purchase with us. We cannot assume any responsibility for property damage or personal injury incurred by or concurrent with the use of the products, even if such damage or injury is the direct result of the failure of the product sold.

If you use products sold by us, please use them at your own risk. We care about riders’ safety. Please consult a qualified technician if you are uncertain of your ability to properly install and use our products.

Motogaga assumes that the individuals performing the installation of its products are certified professional motorcycle maintenance technicians or qualified race mechanics, who can make the judgments and adjustments which may be necessary in the installation process, and which cannot be anticipated by the product manufacturer or us in advance, in order that the installation is a safe and proper one. Motogaga assumes no responsibility for damage or personal injury caused by the actual product or the manner in which products sold are installed.

You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Use or your use of this site shall be filed only in the state or federal courts located in the Country of Malaysia, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.
